<title>Request for Public Comment on Proposed Annual Adjustment of the Statutory Property Damages Limits</title>
<description>REQUEST FOR PUBLIC COMMENT Oregon Tort Claims Act 2012 Annual Adjustment of the Statutory Property Damages Limits Pursuant to ORS 30.273(3), enacted through Senate Bill 311 (2009), the Office of the State Court Administrator (OSCA) has followed the statutory methodology to calculate the annual adjustment to the limitations on liability of public bodies for property damage or destruction. Based on these calculations, we propose to adjust the limitations as follows: $104,300 for any single claimant $521,400 for all claimants The public comment period on the proposed adjustments runs from March 16, 2012, to 5:00 p.m. on April 30, 2012. We will then finalize the adjustments and, pursuant to ORS 30.273(3), the new limitations will become effective on July 1, 2012. They will apply to all causes of action arising on or after July 1, 2012, and before July 1, 2013. In compliance with statute, OSCA will make these adjustments annually. <description>As of June 17, 2011, multiple party filing fees no longer apply to actions for declaratory judgments filed on or after January 1, 2011. [See sections 5, 6, and 7 of HB 2667.] This law change means that some fees in declaratory judgment actions filed between January 1 and June 30, 2011, may be refundable. <title>Notice of New Laws Related to Fines for Violations and State Court Filing Fees as of July 1, 2011</title>
<description>The legislature has passed two bills that will make substantial changes to filing fees in civil cases (House Bill 2710) and fines and assessments in violations and criminal cases (House Bill 2712). Each has an emergency clause and takes effect July 1, 2011, once the Governor signs the bill. The Governor expects to sign the bills the evening of June 30. The bills extend current fees and fines for a few months to provide an orderly transition to new schedules: HB 2710 extends current civil filing fees in trial and appellate courts through September 30, 2011. HB 2712 extends current offense fines and assessments for offenses committed before January 1, 2012. Because some civil filing fees vary by county under current law, users should contact the circuit court directly for fees that apply to an action or document filed in that court. The State Court Administrator has also updated the base-fine schedule for violations committed before January 1, 2012. <title>Reminder - Fees on Certain Civil Motions Take Effect April 1, 2008</title>
<description>New Fees for Certain Civil Motions Effective 4/1/08 [This is a revised date] In 2007, Oregon's legislature authorized Oregon's Chief Justice to establish filing fees for civil motions in state courts (see HB 2331, section 29). The Chief Justice appointed a committee to recommend which motions should be subject to a filing fee. The committee focused on those motions frequently used by lawyers (as opposed to parties who represent themselves) that tend to require significant judge time. It consulted trial and appellate courts throughout Oregon and made recommendations to the Chief Justice. The president of the Oregon State Bar (OSB) requested a delay of the implementation date of the motion fees so that the OSB membership could submit comment. The Chief Justice delayed implementation until April 1, 2008. After considering the comments submitted by the OSB membership, the Chief Justice signed Chief Justice Order 08-015, which establishes filing fees for the following trial and appellate motions and responses filed in civil cases in state courts on or after April 1, 2008. The fees apply only to those cases subject to a fee under ORS 21.010 and 21.110. The fees do not apply to juvenile, postconviction, habeas corpus, and involuntary commitment cases. Motion Filing Fee -- $50 Response Filing Fee -- $35 Courts may not collect the fee from the state, a county, a city, or a school district, or for motions made in court-annexed arbitration or mediation. <title>Chief Justice Identifies Impact of Potential Budget Reductions</title>
<description>Legislative leaders asked the Judicial Department to submit a plan for a potential 9 percent General Fund reduction in the current budget period (which ends June 30, 2011), similar to what the Governor requested from executive branch agencies. The plan, and a transmittal letter from Chief Justice Paul J. De Muniz, is attached. Briefly, the plan: (1) Identifies broad areas of impact of a potential 9 percent General Fund reduction to OJD in the last fiscal year of the biennium. The plan does not detail the number, type, or location of positions that might be affected. That information will not be available until the legislature establishes the amount of any reductions and individual courts and divisions submit plans to address their share of any reduction. (2) Notes that the $13.2 million potential reduction is the equivalent of funding all staff in every court and division of the Judicial Department for seven weeks, or to fund 277 full-time-equivalent staff for 10 months. Note this is expressed as an equivalent to illustrate the significance and seriousness of the level of potential reduction to the OJD budget, it is not the predetermined approach.</description>

<title>Supreme Court Building Security Enhancements</title>
<description>The Judicial Department announces enhanced security at the Supreme Court Building effective September 1, 2006. The Department has contracted with the Oregon State Police to provide a Court Security Officer for the Supreme Court Building during all court business hours. The Officer will control access into the building, screen visitors, and provide on-site security for building staff and patrons. Court visitors will be required to sign in at the new security station at the main entrance (State Street) for access to the State of Oregon Law Library or the Supreme Court courtroom. In addition, the Department will allow most visitors to enter only through the main entrance on State Street. Visitors who need to use the ramp to the accessible entry may continue to use the ramp that leads to the rear entrance. The Department will provide an intercom for those visitors to request entry. <description>NEWS RELEASE For Immediate Release November 20, 2006 Issued by: OREGON JUDICIAL DEPARTMENT Resolution Regarding Professionalism and Fairness in Judicial Elections Campaigns Affirmed by Oregon Judicial Conference The Chief Justice of the Oregon Supreme Court, Paul J. De Muniz, is pleased to announce that the Oregon Judicial Conference affirmed a proposed resolution of voluntary standards for judicial candidates to apply in the conduct of Oregon’s nonpartisan judicial election campaigns. The set of six standards form the basis to promote a positive campaign environment of professionalism and fairness. The resolution encourages a judge candidate to provide information for voters in a manner that ensures for voters, if elected, they would remain fair and impartial in the administration of their judicial duties. The resolution was prepared by Supreme Court Justice Rives Kistler and Court of Appeals Judge Ellen Rosenblum. The standards that judicial candidates are encouraged to adopt asks them • to conduct their political campaigns in a way that is consistent with the judicial office they seek; • to not knowingly make any misleading statement during a campaign; • to not say anything publicly that would commit or appear to commit them to rule in a particular way, or otherwise affect their impartiality, as to any matter likely to come before him or her as a judge; • to not knowingly accept campaign contributions from parties to a case pending before them or in amounts that would reasonably call their impartiality in a case into question; • to conduct campaigns consistently with Oregon's nonpartisan model for judicial elections by neither seeking nor using endorsements or support from political parties; and • to respond to the type of questions in the model questionnaire for judicial candidates prepared by the ABA Coalition for Justice and the Oregon State Bar, but decline those that would reasonably call into question their impartiality on any issue that is likely t</description>
