Conrad R. Engweiler v. Department of Corrections, (S060854) (A152445) (appeal certified by the Court of Appeals).

Petitioner Conrad R. Engweiler filed a petition for judicial review with the Court of Appeals under ORS 183.400, seeking to determine the validity of certain rules promulgated by the Department of Corrections (DOC), including rules and a policy that address whether earned time credits under ORS 421.121 (1989) may be applied to juveniles sentenced to life imprisonment for aggravated murders they committed after November 1, 1989. The Court of Appeals, upon the application of the Department of Corrections and with the concurrence of petitioner, certified the appeal to the Supreme Court pursuant to ORS 19.405, and the Supreme Court has accepted the certification.

On review, the issue is:

Whether the Department of Correction's rules and policy that prohibit application of earned time credits under ORS 421.121 (1989) to juveniles sentenced to life imprisonment for aggravated murders they committed after November 1, 1989, conflict with the Supreme Court's decision in State ex rel Engweiler v. Cook, 340 Or 373, 133 P3d 904 (2006).
