Statement of Issues: | Conrad R. Engweiler v. Rob Persson (S060793) Plaintiff Conrad R. Engweiler has been granted a writ of habeas corpus under ORS 34.370(2)(b)(C), requiring defendant Rob Persson, Superintendent, Oregon State Correctional Institution, to file a return to the writ. The Supreme Court also authorized the parties to waive the filing of the return and replication pursuant to ORS 34.370(4) and proceed to hearing. The issues in this habeas corpus proceeding are as follows: (1) Whether an inmate sentenced outside the Sentencing Guidelines of 1989 to an indeterminate life sentence is entitled to earned time credits under ORS 421.121; and (2) If so, whether, after proper application of earned time credits to plaintiff's sentence, plaintiff is entitled to be released from prison. The foregoing summary of a Supreme Court case that is scheduled for oral argument has been prepared for the benefit of the public.
